Terms of Service

Welcome to Ubahi. Ubahi is an app discovery platform that curates and presents listings of software applications available through third-party app stores. By accessing or using ubahi.com and the Ubahi service (collectively, the “Service”), you agree to these Terms of Service (“Terms”). If you do not agree with these Terms, do not use the Service.

1. Acceptance of Terms

By using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, including any policies or guidelines referenced herein. Ubahi reserves the right to modify these Terms at any time. We will provide notice of material changes and update the “Effective Date” above. Your continued use of the Service after such changes constitutes your binding acceptance of the revised Terms.

2. Changes to Terms

Ubahi may revise, update, or replace these Terms from time to time. We may also suspend or discontinue the Service or any portion thereof with or without notice. It is your responsibility to review the Terms periodically for updates. If you continue to access or use the Service after changes become effective, you indicate your continued acceptance of the Terms as modified.

3. Eligibility and Access

You must be at least the legal age of majority in your jurisdiction and have the legal capacity to form a binding contract to use the Service. You agree not to access the Service through automated means or to impersonate another person or entity. Ubahi may restrict or suspend access for any reason, including violations of these Terms, suspected fraud, or non-compliance with applicable law.

4. Intellectual Property

All right, title, and interest in and to the Ubahi brand, the Service, and all related content, features, and functionality (excluding user content as described below) are owned by Ubahi or its licensors. This includes, without limitation, software, text, graphics, logos, and design elements (collectively, “Ubahi Content”).

You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose in connection with Ubahi’s offerings. You agree not to copy, reproduce, modify, distribute, create derivative works from, display, perform, or otherwise exploit Ubahi Content except as expressly permitted by these Terms or with Ubahi’s prior written consent. Trademarks, service marks, and logos used in the Service are the property of their respective owners.

For user-submitted content, you grant Ubahi a worldwide, royalty-free, sublicensable, irrevocable license to use, reproduce, modify, adapt, publish, translate, distribute, perform, and display such content solely in connection with providing, promoting, and improving the Service. You represent that you own or control all rights to the user-submitted content you upload and that use of such content as described does not infringe any third-party rights.

5. Third-Party Links and Google Play Hosting

The Service functions as a discovery platform. Listings on Ubahi may direct you to applications that are hosted on third‑party platforms, most notably Google Play. Ubahi itself does not host, host-build, distribute, or maintain the app binaries or hosted content shown on Google Play. Ubahi does not claim ownership of the apps, content, or services provided by Google Play or its developers.

Any interaction with those third-party services is governed by the terms and policies of those third parties. You acknowledge that you are leaving Ubahi when you follow a listing to a third‑party store, and you use those third‑party services at your own risk. Ubahi does not guarantee the availability, accuracy, safety, legality, or continued support of any third-party apps or services. We encourage you to review the applicable terms of service and privacy policies of Google Play and the app developers. 6. Disclaimers

The Service is provided on an “as is” and “as available” basis. Ubahi makes no representations or warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy, reliability, or non-infringement. Ubahi does not warrant that the Service will be uninterrupted, secure, error-free, or free of viruses or other harmful components. Use of the Service is at your own risk.

7. Limitation of Liability

To the maximum extent permitted by law, Ubahi, its affiliates, and its licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to damages for loss of profits, data, or goodwill, regardless of the theory of liability (contract, tort, strict liability, or otherwise). In no event shall Ubahi’s total liability to you for all damages, losses, and causes of action exceed the greater of one hundred US dollars (USD 100) or the amount you paid Ubahi, if any, in the twelve months preceding the claim.

8. Indemnification

You agree to indemnify, defend, and hold Ubahi and its officers, directors, employees, agents, and affiliates harmless from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney’s fees) arising from: (a) your use of and access to the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including any intellectual property rights; or (d) any claim that your content caused damage to a third party.

9. Termination

Ubahi may suspend or terminate your access to the Service at any time for any conduct that Ubahi determines violates these Terms or is harmful to other users, Ubahi, or third parties. Upon termination, all licenses granted herein shall terminate, and you must cease all use of the Service. The clauses governing ownership, disclaimers, liability, indemnification, and governing law shall survive termination.

10. Governing Law and Disputes

This Terms of Service shall be governed by and construed in accordance with the laws of the country where Ubahi has its principal place of business, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms or the Service shall be resolved exclusively in the courts located in the jurisdiction where Ubahi has its principal place of business, and you consent to the personal jurisdiction of such courts.

11. Severability and Waiver

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions shall remain in full force and effect. No failure or delay by Ubahi in exercising any right under these Terms shall constitute a waiver of that right.

12. Entire Agreement

These Terms, together with any policies and guidelines referenced herein, constitute the entire agreement between you and Ubahi regarding the Service and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and Ubahi.

13. Assignment

You may not assign or transfer your rights or obligations under these Terms without Ubahi’s prior written consent. Ubahi may assign its rights and obligations under these Terms without restriction.

14. Privacy and Data Security

Your use of the Service is also governed by Ubahi’s Privacy Policy. The Privacy Policy explains how Ubahi collects, uses, stores, and discloses information about you in connection with the Service. By using the Service, you consent to Ubahi’s collection and use of information as described therein.
